These Terms of Service ("Terms") govern your access to and use of healiss.com and any related content, features, tools, products and services (the "Services"), operated by Velaris Commerce LLC ("Healiss", "we", "us", "our"). Please read these Terms carefully. By accessing the Services, placing an order or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

These Terms should be read together with our Privacy Policy, our Refund and Return Policy and our Shipping Policy, each of which is incorporated into these Terms by reference.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to place an order or create an account. By using the Services, you confirm that you meet this requirement and that any information you provide to us is accurate and complete.

Our products

LegFix™ is a compression knee support garment intended for general everyday comfort and support. It is a consumer wellness product. It is not a medical device, it is not intended to diagnose, treat, cure or prevent any disease or medical condition, and it is not a substitute for professional medical advice, diagnosis or treatment.

If you have a diagnosed knee condition, a recent injury, a circulatory or skin condition, or if you are pregnant, consult a qualified healthcare professional before use. Discontinue use and seek medical advice if you experience pain, numbness, irritation, swelling or any adverse reaction. Never ignore or delay seeking professional medical advice because of something you have read on the Services.

Customer reviews, testimonials and statements shared on the Services reflect the individual experiences of the people who provided them. They are not a guarantee, promise or prediction of results, and individual experiences will vary.

Products, pricing and availability

We make reasonable efforts to display our products, prices and descriptions accurately, but we do not warrant that product descriptions, images, colors, pricing or other content on the Services are error-free, complete or current. Colors and details may appear differently depending on your screen.

All prices are shown in the currency indicated at checkout and are subject to change without notice. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice, including after you have submitted an order. Products and promotions are offered subject to availability and may be limited in quantity or withdrawn at any time.

Orders and acceptance

Your submission of an order is an offer to purchase. We accept your order when we send you an order confirmation. We reserve the right to refuse, limit or cancel any order for any reason, including where a product is unavailable, where an error in pricing or product information has occurred, where we suspect fraudulent or unauthorized activity, or where an order appears to be placed for resale. If we cancel an order after payment has been taken, we will issue a full refund.

Payment

By submitting an order, you represent that you are authorized to use the payment method provided and you authorize us to charge the full order amount, including taxes and shipping where applicable, to that payment method. Payments are processed by third-party payment providers, and your use of those services may be subject to their own terms.

Shipping, delivery and customs

Orders are shipped by our international fulfilment partner. Delivery estimates are estimates only and are not guaranteed. Delivery may be affected by customs processing, carrier delays or events outside our control. Risk of loss passes to you upon delivery to the address you provide.

You are responsible for providing a complete and accurate delivery address. Where import duties, taxes or customs charges apply, these may be the responsibility of the recipient depending on the destination country. Full details are set out in our Shipping Policy.

Returns and refunds

Refunds, replacements and returns are governed by our Refund and Return Policy, which forms part of these Terms. Nothing in these Terms limits or replaces any rights you may have under the consumer laws that apply where you live.

Digital bonus materials

Certain orders include complimentary digital materials, such as guides or video content. These materials are licensed to you for your personal, non-commercial use only. You may not copy, resell, distribute, publish or share them. Because they are delivered immediately, digital materials are non-refundable. We may modify or discontinue digital materials at any time.

Acceptable use

You agree not to use the Services for any unlawful purpose, or to:

• Violate any applicable law, regulation or third-party right
• Submit false, misleading or fraudulent information, or impersonate any person
• Upload or transmit any virus, malicious code or material designed to interfere with the Services
• Attempt to gain unauthorized access to the Services, other accounts or our systems
• Scrape, harvest, mine or otherwise extract data from the Services by automated means
• Interfere with, disrupt or place undue burden on the Services or their infrastructure
• Use the Services to harass, abuse or harm another person

We may suspend or terminate your access to the Services at any time, without notice, if we believe you have breached these Terms.

Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at support@healiss.com if you believe your account has been compromised.

Intellectual property

All content on the Services — including text, graphics, logos, images, video, product designs, page layouts and software — is owned by us or our licensors and is protected by intellectual property laws. "Healiss" and "LegFix" are our trademarks. You may not copy, reproduce, modify, distribute, republish, or create derivative works from any part of the Services without our prior written permission, except that you may view and print content for your own personal, non-commercial use.

User content and reviews

If you submit a review, photograph, comment or other content to the Services, you grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable license to use, reproduce, publish, adapt and display that content in connection with our business, including in marketing, without compensation to you. You confirm that the content is your own, is accurate, does not infringe any third-party right and is not unlawful or offensive. We are not obliged to publish any content you submit, and we may remove or edit content at our discretion. We do not offer payment or incentives in exchange for reviews.

Third-party links and services

The Services may contain links to third-party websites or services that we do not control. We are not responsible for the content, products, policies or practices of those third parties, and we do not endorse them. Any dealings you have with a third party are solely between you and that third party.

Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free or free of harmful components, or that any content on the Services is accurate, complete or current.

This section does not exclude or limit any warranty, guarantee or right that cannot be excluded or limited under the consumer laws that apply where you live. In particular, our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and customers in the United Kingdom retain their rights under the Consumer Rights Act 2015.

Limitation of liability

To the fullest extent permitted by law, Velaris Commerce LLC, its officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Services or any product purchased through them, whether based in contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Services or any product will not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Velaris Commerce LLC and its officers, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from causes beyond our reasonable control, including natural disasters, war, civil unrest, epidemics, labor disputes, carrier or supplier failures, customs actions, or failures of telecommunications or internet infrastructure.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

If you are a consumer resident in the United Kingdom, the European Economic Area, Australia or Canada, this section does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of your country of residence.

Severability and waiver

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Changes to these Terms

We may update these Terms from time to time, for operational, legal or regulatory reasons. The revised version will be posted on this page with an updated "Last updated" date and will take effect when posted. Your continued use of the Services after that date constitutes acceptance of the revised Terms. The Terms in effect at the time you place an order will govern that order.
